01.1. Agreement to Terms

These Terms and Conditions (the "Terms", "Agreement") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("Client", "you", "your"), and Ergo Setup Boston LLC, a limited liability company organized under the laws of the Commonwealth of Massachusetts, doing business as ErgoAssembly ("ErgoAssembly", "we", "us", "our").

By accessing our website (ergoassemblyboston.com), submitting a quote request, booking an appointment, or utilizing our assembly, repair, or donation pickup services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our website or services.

02.2. Description of Services & Service Territories

ErgoAssembly provides specialized mobile on-site furniture services, encompassing four primary service categories:

1. Ready-to-Assemble (RTA) Furniture Assembly: Professional assembly, structural framing, hinge adjustment, and precision leveling for residential and commercial furniture (including beds, dressers, desks, wardrobes, dining sets, gazebos, and outdoor patio sets).

2. White-Glove & Specialty Assembly: Unboxing, narrow doorway handling, and calibration for luxury wellness furniture, robotic massage chairs, zero-gravity recliners, and ergonomic workstations.

3. In-Home Technical Furniture Repair: Diagnostic assessment and component replacement (including linear actuators, 29V power transformers, control boxes, and hand wands) for motorized power recliners, medical lift chairs, smart beds, and standing desks.

4. Free Furniture Donation Pickup: Courtesy removal, indoor extraction, teardown, and transport of qualifying used furniture in good condition.

• Geographical Scope: Our primary service area encompasses Greater Boston and the Commonwealth of Massachusetts. We also fulfill pre-scheduled commercial and residential bookings in neighboring New England states (such as New Hampshire, Rhode Island, and Connecticut) as mutually agreed in writing per booking.

03.3. Quote Request, Accuracy of Information & Reference Photos

• Client Representation: Quotes are calculated based on the specifications, furniture models, dimensions, staircase/floor access, and photographs submitted by the Client. The Client warrants that all information provided is accurate and representative of the actual workspace and item condition.

• On-Site Quote Adjustments: If upon arrival the technician discovers that the items differ substantially in quantity, model complexity, assembly condition, or physical access from the submitted description, ErgoAssembly reserves the right to adjust the flat-rate price to reflect the true scope of work or reschedule the service.

04.4. Workspace Readiness, Safety & Access Requirements

• Cleared Workspace: The Client must ensure a clean, cleared, and safe workspace prior to technician arrival. The assembly area must provide adequate lighting, ventilation, and power access.

• Safety of Occupants: Children, domestic pets, and bystanders must remain clear of the active assembly or repair workspace at all times.

• Right of Refusal: Technicians reserve the right to refuse service and depart if they encounter hazardous, unsanitary, or hostile conditions (such as biohazards, active pest infestations, severe structural risks, or aggressive animals). In such cases, a $75 safety trip fee applies.

05.5. Cancellation and Rescheduling Policy

• Notice Requirement: Clients may reschedule or cancel appointments without penalty with at least twenty-four (24) hours' advance notice.

• Late Cancellations: Cancellations or rescheduling requests made less than 24 hours prior to the scheduled window are subject to a $50 late fee.

• No-Show: If the technician arrives and the Client cannot be reached or fails to provide property access within fifteen (15) minutes of the scheduled start time, the appointment will be deemed a no-show subject to a $75 fee.

06.6. Payment Terms

• Due Upon Completion: Payment for assembly and repair services is due in full immediately upon completion of the service, prior to the technician departing the premises.

• Accepted Methods: We accept major credit/debit cards and secure electronic payments. Cash or checks require prior written arrangement.

07.7. Scope of Warranty, Workmanship & Defect Disclaimers

• Assembly Workmanship & Immediate On-Site Verification: Our guarantee covers the direct physical workmanship of assembly performed on-site. Upon completing assembly or repair, our technician conducts a thorough operational check and functional walkthrough with the Client to verify that the item is properly assembled, level, and functional. The Client's inspection and acceptance at the conclusion of the visit confirms satisfactory completion. We do not provide post-service multi-day or 7-day warranties, as long-term furniture durability is governed by manufacturer material quality, weight distribution, and customer everyday use.

• Manufacturer & Retailer Defects: ErgoAssembly is an independent assembly and repair service provider, not the manufacturer, retailer, or distributor of your furniture. We are NOT responsible for manufacturer material defects, damaged/cracked panels discovered inside pre-sealed factory packaging, warped wood, chipped veneer, stripped factory pre-drilled holes, missing hardware from the factory, or flawed manufacturer blueprints. All manufacturer defects must be addressed directly with the seller or manufacturer (e.g., Wayfair, Amazon, IKEA, Target, etc.).

• Scope of Technical Repair Services: For furniture repair, our warranty is strictly limited to the proper on-site physical installation and electrical connection of the agreed replacement component (e.g., linear actuator, 29V power box, hand wand). We do not manufacture third-party electronic components and are not liable for subsequent unrelated electrical or mechanical failures of the furniture.

• Free Furniture Donation Pickup Scope: Free donation pickups are executed strictly as a courtesy logistics service to remove qualifying items in good used condition. Once the item is removed from the property, ownership transfers to ErgoAssembly/donation distribution networks, and the service is deemed fully completed with zero monetary compensation, exchange value, or ongoing liability.

• Wall Anchoring & Disclaimers: When anchoring furniture (e.g., bookcases, heavy dressers, wall mounts), we rely on client-designated placement. We are not liable for pre-existing concealed in-wall hazards (such as unshielded electrical wiring or plumbing) not disclosed to us.

• Limitation of Liability: To the maximum extent permitted under applicable law, the total cumulative liability of Ergo Setup Boston LLC, its officers, members, and technicians for any claim arising out of our services shall not exceed the total amount paid by the Client for the specific service.

08.8. Governing Law and Legal Jurisdiction

• Governing Law: This Agreement, and all claims or disputes arising out of or related to our website and services, shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

• Exclusive Jurisdiction: Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Boston, Massachusetts, and you hereby consent to the personal jurisdiction and venue of such courts.

09.9. Severability & Entire Agreement

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severable without affecting the validity of the remaining provisions. These Terms constitute the entire understanding between the Client and Ergo Setup Boston LLC.
